Family Education Rights and Privacy Act (FERPA)
Literacy Phoenix, as an adult education provider, serves individuals 16 years of age or older who are not enrolled in the K-to-12 system.
Literacy Phoenix adheres to the Family Educational Rights and Privacy Act (FERPA) in providing students with full control over their educational records when they are 18 years or older. These students have the right to access their academic records, request corrections to inaccurate or misleading information, and control the disclosure of their records to third parties. Parents do not automatically have access to their adult child’s educational records without the student’s written consent, unless the student is a minor or a specific exception applies.
Literacy Phoenix upholds these rights and ensures that students’ personal and academic information is kept confidential unless disclosure is legally permitted.
Literacy Phoenix provides parents of students under 18 years of age with an opportunity to inspect and review the education records of their child, upon request.
Annual Notification of Right
Literacy Phoenix, in compliance with the FERPA Law, reinforces the Annual Notification Right as follows:

- Literacy Phoenix orientation includes an explanation of the FERPA Law.
- All students fill out the most recent version of the participant registration form, provided by the Arizona Department of Education / Adult Education Services, where FERPA Law is included for acknowledgement.
- The Literacy Phoenix webpage includes an explanation of the FERPA Law.
- FERPA Law statement for acknowledgement is posted in our digital board located in each Learning Center and other visible places for students, parents, staff, and any other visitors.
- A brief reminder that students and parents are protected by FERPA Law is included in the periodic email sent to the students with a link to read more.

Safety of Students
Literacy Phoenix discloses personally identifiable information from students’ education records to address safety issues in a manner that complies with the FERPA Law.
Literacy Phoenix is under the FERPA law, using the power to act decisively and quickly when the need arises, and is an important part of emergency preparedness.
When a health or safety emergency arises, Literacy Phoenix takes on a case-by-case approach, considering the totality of the circumstances about the threat to the health or safety of the student or others and once it is determined that there is a significant threat, and a party needs personally identifiable information from education records to protect the health or safety of the student or other individuals, it may disclose that information to appropriate parties without consent. As part of student safety, students provide an emergency contact name and phone number during the registration process.
Military Recruiters
Literacy Phoenix, in compliance with the FERPA law, provides student information to military recruiters, when requested, unless the student or the parent of a minor has opted out of providing such information. As part of the FERPA law policy, adult students and, where applicable, their parents or guardians are notified of this information during orientation, registration, in the webpage and on periodical email sent at least once a year.
When there is a request for information from the Military Recruiters, the students are informed by email and in digital boards visibly located on each Learning Center and they can change to opted out prior the information is sent.
The information required to be provided to military recruiters includes student names, addresses, electronic mailing addresses, and telephone listings.
